Terms of Service

This document is a template for a real product. Before launching to paying customers, have a qualified lawyer in your jurisdiction review and adapt it to Philippine law (RA 10173 for privacy) and any other jurisdiction you serve.

Welcome to NythosX Market Alerts ("NythosX", "we", "us"). By creating an account or using any part of the service you agree to these terms.

1. The service

NythosX provides price monitoring, alert delivery, portfolio bookkeeping, and rules-based market analysis tools. NythosX does not execute trades, hold customer funds, provide brokerage services, or act as a financial adviser.

2. Your account

You are responsible for the security of your account and any API keys you generate. Keep your password confidential. Notify us immediately if you suspect unauthorised access.

You must be at least 18 years old to use the service.

3. Subscriptions and billing

Paid plans renew automatically at the interval shown at checkout. Cancellations take effect at the end of the current billing period. See the refund policy for details.

4. Acceptable use

You agree not to:

Resell, sublicense, or provide the service to third parties without a written agreement.
Attempt to reverse engineer, scrape beyond published rate limits, or interfere with the service.
Use the service to violate any law, including market manipulation or insider trading.
Use automated tools to create accounts or bypass tier limits.

We may suspend or terminate accounts that violate these rules.

5. Availability

We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, upstream provider outages (Coinbase, Binance, Yahoo Finance, Resend, Stripe, Cloudflare), or force-majeure events may cause interruptions. Alert delivery is best-effort; you should not rely on NythosX as your only source for time-critical decisions.

6. No investment advice

All content, including the Advisor, the Candle Tutor, forecast cycles, backtests, and portfolio metrics, is informational only and does not constitute investment, tax, or legal advice. See the disclaimer.

7. Intellectual property

NythosX, its logo, and its software are our property. You receive a limited, non-transferable licence to use the service under these terms.

8. Limitation of liability

To the maximum extent permitted by law, NythosX is not liable for indirect, incidental, special, or consequential damages, including lost profits or trading losses. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time from Account → Sessions & data. We may suspend or terminate accounts for violation of these terms, fraud, or non-payment.

10. Changes to these terms

We may update these terms. Material changes will be announced by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These terms are governed by the laws of the Republic of the Philippines. Disputes shall be resolved in the courts of the Philippines.
